Location: Hidden Cypress Farm LLC, 2910 U.S. 231, Cottondale, Florida 32431
In consideration of being permitted to enter upon and use the premises, facilities, equipment, and participate in agritourism activities provided by Hidden Cypress Farm LLC (“Farm”), the undersigned (“Participant”) agrees as follows:
1. Assumption of Risk
I understand and acknowledge that participation in agritourism activities at the Farm involves inherent risks, both known and unknown, which may result in personal injury, illness, permanent disability, or death, as well as property damage or loss. These risks include, but are not limited to:
Use of equipment and attractions such as bounce pad, jump pad, corn pit, train ride, fire pit, zip line, pedal cars, tricycles, slides, swings, decks, tunnels, fire pit, balloon launcher, giant Jenga, S’mores marshmallow holders, corn hole, all games, cutting and bailing Christmas trees, loading Christmas Tress, ;
Contact with animals, plants, and natural outdoor conditions;
Risks associated with uneven ground, weather conditions, insects, and other environmental hazards.
I voluntarily assume all risks, hazards, and responsibilities associated with participation.
2. Release and Waiver
I, on behalf of myself, my children, heirs, assigns, personal representatives, and estate, hereby release, discharge, and hold harmless Hidden Cypress Farm LLC, its owners, members, employees, agents, and volunteers from any and all claims, demands, causes of action, liability, costs, or damages arising out of or in connection with participation in any activity on the Farm, including but not limited to negligence (except in cases of gross negligence or willful misconduct as defined by Florida law).
3. Indemnification
I agree to indemnify and defend Hidden Cypress Farm LLC against any and all claims, suits, actions, damages, and liabilities, including attorney’s fees, arising from my participation or that of my minor children in the Farm’s activities.
4. Agritourism Law Notice
Pursuant to Florida Statute §570.89:
“Under Florida law, an agritourism operator is not liable for injury or death of, or damage or loss to, a participant in an agritourism activity conducted at this agritourism location if such injury, death, damage, or loss results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury, death, damage, or loss. You are assuming the risk of participating in this agritourism activity.”
5. Medical Authorization
I authorize the Farm to provide or obtain medical care for me or my child(ren) in the event of an emergency and agree to be financially responsible for any such care.
6. Severability
If any provision of this Agreement is held invalid, the remainder shall continue in full force and effect.
7. Binding Effect
This Agreement shall be binding upon me, my heirs, executors, administrators, and assigns.
